Probate, whether formal or informal, is the process of winding up the affairs of the person who has died (the decedent) and includes asking the court to appoint a personal representative (sometimes called an “executor”) of the decedent’s estate, and to determine if there is a valid will. Once the personal representative has been appointed they are able to gain access to the assets of the estate.

Training is required in order to be appointed as a personal representative. Information regarding required training can be located here: https://www.azcourts.gov/probate/training
Not all estates are required to go through the entire probate process. If the total value doesn’t exceed the states requirements Small Estate Affidavits can be filed. Legal Doc’s LLC can assist you with preparing and filing the Affidavit’s with the court.
